HOW WE CAN HELP

Our property law services

We combine litigation experience with practical, commercial thinking: the goal is to restore your property and your income as quickly as the law allows. Done properly the first time, an eviction is dramatically faster than one struck off for a procedural defect.

Residential & commercial evictions

Lawful evictions the right way: proper notice, cancellation of the lease, and a correctly brought PIE Act or common-law application.

Landlord-tenant disputes

Unpaid rental, breach of lease, damage and deposit disputes, resolved by demand, negotiation or litigation. We act for both sides.

Lease agreements

Residential and commercial leases with enforceable breach, cancellation and escalation provisions, so your lease works for you when things go wrong.

Property disputes

Boundary and servitude disputes, disputes arising from sale agreements, defects after transfer, and other property litigation.

The eviction process, step by step

(1) Notice of breach and demand; (2) cancellation of the lease if the breach isn’t remedied; (3) application to court under the PIE Act, served on the occupier and the municipality; (4) a hearing at which a vacating date is set; (5) execution by the sheriff if needed. We handle every step and move fast, because every month of delay is money out of your pocket.

An unopposed eviction in the Magistrates’ Court typically takes around two to four months. Opposed evictions take longer. Procedural mistakes are what make evictions slow.

Yes, but only through the courts. You may not lock the tenant out, cut services or remove their belongings, no matter how much is owed.

You are entitled to proper notice, a lawful court process and the opportunity to oppose. An eviction order can only be granted by a court after considering whether it is just and equitable.

PIE Act applications have strict procedural requirements. Applications that miss one get struck off, costing months. An experienced eviction attorney is nearly always cheaper than the delay of doing it wrong.
